She was not willing to be detained under the Mental Health Act but agreed to an assessment of her home treatment. The examiner, however, was concerned that she was a danger to herself or others. She did not believe she was competent enough to give consent.

The assessor then recommended that Miss Kelly should be held against her will. Miss Kelly did not want to be in a ward, so she contacted Dr Ramanathan Elayaperumal, her psychiatrist. He was a Consultant Psychiatrist with the Home Treatment Team at Essex Partnership NHS Foundation Trust.

Elayaperumal claims that Medtronic intentionally denied him a job due to his race and national origin. He claims that his poor performance review in June of 2000 and the denial to give him certain projects assignments were influenced by racism. Medtronic has not provided evidence that its decisions were based on these factors. Elayaperumal’s lower performance rating did not cause any reduction in his compensation or benefits.
