She refused to be detained by the Mental Health Act but agreed to an assessment of home treatment. The person who assessed her feared she was a danger to herself or others. She was not convinced she was competent enough to give consent.

In the end, the assessor advised that Miss Kelly be held against her will. Miss Kelly was not keen to be admitted to a facility and called her psychiatrist, Dr Ramanathan Elayaperumal. He was a Consultant Psychiatrist in the Home Treatment Team at Essex Partnership NHS Foundation Trust.

In response to this suggestion, the Home Treatment Team conducted a thorough assessment of Miss Kelly's state mind and her current functioning. The review included an in-depth medical history as well as a physical exam. The review also included a comprehensive private psychological evaluation assessment, family therapy assessment and a psychiatric diagnosis interview.

According to the report Miss Kelly suffered from a number of mental health issues, including borderline personality disorders such as bulimia, anorexia and bulimia. She also had an history of addiction to drugs and domestic abuse. Her symptoms were worsened by anxiety, stress, and depression. She was also diagnosed as having bipolar affective and schizoaffective disorder.

Elayaperumal claims Medtronic discriminated against him in a deliberate way due to his race or nationality. He argues that Medtronic's low performance review in June 2000 and the failure to provide him with certain assignments for projects were motivated by racism or national animus. Medtronic has not provided any evidence that its decisions were based on these factors. Moreover, Elayaperumal's lower performance review did not result in any reduction in his compensation or benefits, nor did it affect his the responsibilities he had.
