In June of 2016, a woman named Miss Kelly spoke to a community psychiatric nurse that she wanted to commit suicide. She refused to be detained under the Mental Health Act but agreed to an assessment of treatment at home. The assessor was concerned that she was a risk to herself or others and did not believe she was competent enough to give consent.

As a result, the assessor advised that Miss Kelly be detained against her will. Miss Kelly did not want to be in a facility, so she called Dr Ramanathan Elayaperumal, her psychiatrist. He was a Consultant Psychiatrist with the Home Treatment Team at Essex Partnership NHS Foundation Trust.

In response to this recommendation In response to this recommendation, the Home Treatment Team conducted a comprehensive evaluation of Miss Kelly's state of mind and functioning. The review included a thorough medical history and physical examination. It also involved a detailed assessment of family and psychological therapy as well as a psychiatric diagnostic interview.

According to the report the report states that Miss Kelly was afflicted by multiple mental health issues, such as borderline personality disorder, bulimia nervosa and anorexia nervosa. She had also been victimized by her husband and was a drug addict. Her symptoms were worsened by stress, anxiety, and depression. She was also diagnosed with bipolar affective disorder as well as schizophrenia-related disorder.

Elayaperumal claims that Medtronic deliberately denied him a job due to his race and nationality. He claims that his poor performance review in June 2000 as well as the inability to give him specific project assignments were motivated by national origin or racism animus. Medtronic has not provided any evidence that its decisions were based upon these elements. Elayaperumal’s lower performance rating did not result in any reduction in his compensation or benefits.
