The assessor recommended that Miss Kelly should be held against her wishes. Miss Kelly did not want to go to a hospital, so she contacted her psychiatrist, Dr Ramanathan Elayaperumal. He was a Consultant Psychiatrist in the Home Treatment Team at Essex Partnership NHS Foundation Trust.

The review included an in-depth medical history as well as a physical exam. The review also included a comprehensive psychological assessment, a family therapy assessment and a psychiatric diagnose interview.

According to the report the report states that According to the report, Kelly was afflicted by multiple mental health issues, including borderline personality disorder, bulimia nervosa, and anorexia nervosa. She was also assaulted by her husband and was a drug addict. Stress, anxiety and depression exacerbated her symptoms. She was also diagnosed as having bipolar affective and schizoaffective disorder.

Elayaperumal claims that Medtronic intentionally denied him a job due to his race and national origin. He claims that his poor performance review in June 2000 and the failure to give him specific project assignments were influenced by racism or national origin animus. Medtronic has not provided any evidence that its decisions were based upon these factors. Moreover, Elayaperumal's lower performance review did not lead to any reduction in his salary or benefits, nor did it affect his duties.
